There is a story on USCHO saying that Potsdam State has been given two years of probation and a post-season ban for doing exactly what Union College has been doing for years. International grants which favor athletes. Anyone see that? Of course, Union got grandfathered in as D-1 in hockey so they are not in jeopardy as long as they don't exceed the limit of 18. But there is an AHA team that plays D-1 that was NOT grandfathered in (and thus must abide by D-3 rules) that looks like it might run afoul of the same rule if the NCAA chose to look their way.

The worst of this story at Potsdam State, is the fact that the financial aid packages were given out through a "blind process". Meaning, the school had no idea if the incoming student would play a sport or not.

Which is why the NCAA noted that it was an unintentional violation and unintentional bias.

I don't think Union was grandfathered. The grandfather clause affected those schools who were (a) playing up, and (b) offering athletic scholarships when the waiver was passed. IIRC, only CCT, SLU, RPI and CC in ice hockey are the exempt schools.
RIT and UC are the other D-III playups and can't offer anything resembling athletic grants in aid. I would imagine that they have to follow the D-III rules in toto, but I'm not a compliance officer.
BTW, new play-ups are dead. Prop 2010-100, which kills the play-ups (among other things), passed in May and takes effect on August 1.

However, if 90% of the international aid is going to athletes, they have some explaining to do.
